This Legal Notice applies to DGC POS — POS Smart Solution and supplements our Terms of Use and Privacy Policy. By using the Service, you agree to all applicable legal documents.

1. Operator and platform

DGC POS (POS Smart Solution) is a cloud-based software platform for retail and hospitality businesses, offered free during public beta. The Service is operated by the owner and operator of DGC POS (trade name), pending formal company registration details to be published on these legal pages under the DGC POS trade name and brand.

DGC POS — POS Smart Solution is a cloud-based software platform, offered free during public beta. No platform subscription fees are charged by us during public beta. Paid DGC POS Pro plans may be introduced later. The Service is operated under the DGC POS trade name. Formal company name, registered address, and registration number will be published on this site when registration is complete.

DGC POS uses a dual model: (1) DGC POS Community — open-source, self-hostable POS published on GitHub under an explicit open-source license; and (2) DGC POS Cloud — the hosted product at app.dgcpos.com, which is proprietary managed software governed by our Terms of Use. Free cloud access during public beta is not the same as open-sourcing the entire cloud platform. Paid DGC POS Pro may be offered later for advanced features.

Upon completion of company registration, the owner may assign or transfer these rights and obligations to the registered entity. Updated legal documents will be published on dgcpos.com where required by applicable law.

2. Ownership of intellectual property

All rights, title, and interest in the Service — including software, source and object code, databases, interfaces, documentation, trademarks, logos, trade dress, and brand assets — belong to the Operator and/or its licensors. No user acquires ownership rights by signing up, participating in beta, paying fees, or using the Service.

3. Cloud software disclaimer

The Service is delivered over the Internet from cloud infrastructure. We do not guarantee uninterrupted access, permanent feature availability, or compatibility with every device, browser, printer, payment terminal, or third-party system. You are responsible for your own internet connectivity, hardware, and local business continuity planning.

4. Beta and pre-release use

Where the Service is offered in beta, preview, guest, or trial mode:

Features may be incomplete, experimental, or withdrawn without notice.
Downtime, defects, and data changes may occur.
Demo or sample data may be provided for illustration only.
Access may be restricted by geography, approval workflow, or capacity limits.
Commercial pricing and billing terms may not be final.

Beta use is at your sole risk. The Service should not be your only system of record unless you maintain adequate independent backups.

5. User compliance responsibility

You are solely responsible for compliance with all laws, regulations, tax rules, consumer protection obligations, employment requirements, payment licensing, data protection duties, and industry standards applicable to your business in every country and region where you operate. The Operator does not monitor or guarantee your legal compliance.

6. Third-party services

The Service may integrate with or depend on third-party cloud providers, payment gateways, messaging systems, and other vendors. Those parties are independent and operate under their own terms. The Operator is not responsible for their acts, omissions, outages, fees, or policies except as expressly stated in our Terms.

7. No investment offer

Nothing on dgcpos.com or app.dgcpos.com constitutes an offer to sell securities, a solicitation of investment, or a promise of valuation, profit, or future funding. Any investment or partnership arrangement requires a separate written agreement and applicable legal compliance.

8. Limitation of reliance

Marketing materials, demos, screenshots, roadmaps, and verbal statements are for general information only and do not create warranties or contractual commitments unless expressly included in a signed written agreement.

9. Enforcement rights

We reserve all rights to protect the platform, brand, and users, including suspending accounts, removing content, restricting access by region, modifying features, and pursuing legal remedies for misuse, infringement, or unauthorized access.

10. Governing law

This Legal Notice is governed by the laws of Nepal (laws of Nepal), without prejudice to mandatory consumer protections that apply in your country of residence when published, consistent with our Terms of Use. Mandatory local law may apply where you reside or operate.
